This Privacy Policy relates to information collected by Kano & Co. LLC  (referred to in this Privacy Policy as "Kano & Co." "we" or "us" or "our") through your use of our website and our Services, features, and information available on our website (which are collectively referred to in this Privacy Policy as "Kano & Co. What Information do we Collect?​

You will need to establish an account in order to take advantage of certain features of the Kano & Co. Service. If you wish to establish an account you will be required to provide us with personally identifiable information. In addition, we may obtain your personally identifiable information from you if you identify yourself to us by sending us an e-mail inquiry with questions or comments. Depending on your use of Kano & Co. Service, we collect two types of information: personally identifiable information, and non-personally identifiable information.

Personally Identifiable Information identifies you or can be used to identify or contact you. Examples of personally identifiable information include your name, IP address, company name, job title, address, e-mail address, telephone number, and/or billing and credit card information.

 

Non-Personally Identifiable Information

Non-personally identifiable information is information, any single item of which, by itself, cannot be used to identify or contact you, including demographic information (such as age, profession, company industry, gender, current location, or zip code), IP addresses, browser types, domain names, and statistical data involving the use of the Kano & Co. Service. Additionally, when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers, email address, and phone number.  We refer to this information as “Order Information.”

How is my personal information shared?

Our company website is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. Wix stores your data on secure servers behind a firewall. 

 

All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

We share your Personal Information with third parties to help us use your Personal Information, as described above. We may employ or refer independent contractors, vendors, suppliers, and service providers including but not limited to Spoak, Flodesk, Calendly, Zendesk, and ClickUp (collectively, "Outside Contractors") to provide specific services and products related to the Kano & Co. Service, such as mailing list hosting, credit card processing, system integration, and design visualization for the Kano & Co. Service. In the course of providing products or services to us, these Outside Contractors may have access to information collected through the Kano & Co. service website, and any personally identifiable information volunteered by you throughout the Kano & Co. service processes. Please be aware that each of these vendors, and service providers have their own governing privacy policies and any information you share, and consent you give by utilizing their services will be governed accordingly. We are not responsible for the privacy practices of any websites or services other than Kano & Co. Services. We encourage you to read the privacy policies or statements of each and every such website and service. This Privacy Policy applies solely to information collected by us through Kano & Co. Services.

Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

 

What about behavioral advertising?

How Long will Data be Stored?

We will only retain your personal data as long as reasonably required for you to use the Site/Application(s) and/or to provide you with the Services unless a longer retention period is required or permitted by law (for example, for regulatory purposes). When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information. 

 

Where will Data be Transferred to?

Your data, including personal data that we collect from you, may be transferred to, stored at and processed by us and other third parties outside the country in which you reside, including, but not limited to the United States, where data protection and privacy regulations may not offer the same level of protection as in other parts of the world. By using our platform, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this policy. Your team's project and task data will never be transferred to third parties. The only data we share with third parties is for analytics, error tracking, and marketing.

Do we Collect Information from Children under 16 years of age? We are committed to protecting the privacy of children. Kano & Co. design services is not intended for or directed to children under the age of 16. We do not collect personally identifiable information from any person we know is under the age of 16.

We may disclose your information (including personally identifiable information) if we believe in good faith that we are required to do so in order to comply with an applicable statute, regulation, rule or law, a subpoena, a search warrant, a court or regulatory order, or other valid legal process. We may disclose personally identifiable information in special circumstances when we have reason to believe that disclosing this information is necessary to identify, contact, or bring legal action against someone who may be violating our Terms of Service, to detect fraud, or to protect the safety and/or security of our users, the ClickUp Service or the general public. We are subject to the investigatory and enforcement powers of the Federal Trade Commission (FTC). We also may be required to disclose an individual’s personal information in response to a lawful request by public authorities, including to meet national security or law enforcement requirements. Subject to the next paragraph, we ask that you not send or disclose to us any sensitive personal data (e.g., social security numbers, information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, criminal background or trade union membership) on or through [the Site/Applications(s)/Services] or otherwise. If you send or disclose any sensitive personal data to us when you submit user-generated content to [our Site/Application(s)/Services], you consent to our processing and use of such sensitive personal data in accordance with this policy.
